Delaware woman sues Tabu for alleged injuries

Kimberley J. Lowry of Camden, Delaware has filed suit against Tabu, claiming she suffered severe injuries while navigating her way up a ramp to gain access to the venue’s roof deck.

On Nov. 5, Lowry filed an 11-page complaint against Tabu — recently rebranded as “254” — in Philadelphia Common Pleas Court.  The bar and venue is located at 254 S. 12th St. and caters to the LGBTQ+ community.

Lowry is suing for more than $50,000 and has requested a jury trial.

The alleged incident occurred on April 15, 2023. Lowry was trying to get onto Tabu’s wooden roof deck when she slipped on a wet ramp and caught her toe on a raised metal strip — resulting in a serious fall, according to the lawsuit.

Lowry allegedly sustained “severe” injuries to her ankle and leg. The accident also aggravated pre-existing conditions that she suffers from, according to the lawsuit.

The lawsuit faults Tabu for not having cones, barricades, barriers or other types of security devices to make the area of the deck safer.

Her lawsuit cites Tabu for negligence due to failing to maintain a safe establishment and failing to warn patrons of allegedly hazardous conditions.

Additionally, Lowry has expended large sums of money for medical care to treat her injuries, and expects to incur additional medical costs in the future. Moreover, the injuries allegedly have interfered with her daily functioning.

She’s seeking more than $50,000 in damages from Tabu, along with attorney fees and costs.
