The jury clearly indicates in response to questions #3 and #4 that the City of Philadelphia was both “reasonable” and “viewpoint-neutral” for its attempt to evict the Scouts for their continued discriminatory practices on publicly owned land.

Question #11- Did Plaintiff prove, by a preponderance of the evidence that Defendant’s (City of Philadelphia) termination of the Plaintiff’s (Scouts) rent-free occupancy of City-owned property had no rational basis related to Defendant’s legitimate interest in eliminating discrimination against gays?

Answer – No

These three responses by the jury would seem to call into question whether the Scouts would be able to lay claim to full legal fees against the City – despite claims made by the Scouts legal team to that effect.
